We draft and review Severance Agreements on behalf of our clients.  A severance agreement contains terms and provisions that both employer and employee must follow in the event that an employee’s employment is terminated and severance pay will be issued.  In exchange, the employee agree to release the employer from certain potential claims.  Possible claims are generally things like discrimination, wrongful termination, and harassment.

It is always a good idea to make sure that any severance agreement is in writing.  This benefits both employer and employee in that it prevents future ambiguity and creates an agreed-upon course of conduct moving forward for all parties involved.  Examples of services that we offer for severance include:

  • Recommending the best course of employment termination;
  • Drafting severance agreements and employment releases;
  • Reviewing existing agreements;
  • Counseling employees and employers on the terms of previous agreements.
